PHMSA Publishes Three Hazardous-Materials Special-Permit Notices

October 19, 2026 12 min read

PHMSA published separate notices for actions on special permits, applications to modify existing permits and applications for new permits—three distinct stages that carriers and offerors should not confuse.

Three PHMSA notices were published October 19

The Pipeline and Hazardous Materials Safety Administration published three separate Federal Register notices on October 19, 2026, at 91 FR 66196–66199. Together they cover actions on special permits, applications to modify existing special permits and applications for new special permits under the Hazardous Materials Regulations.

Document 2026-21308 reports agency actions

The notice titled Hazardous Materials: Notice of Actions on Special Permits states that the Office of Hazardous Materials Safety has granted or denied the applications described in its table. An action notice is the decision stage, but each entry remains applicant- and permit-specific. It is not a general amendment to the Hazardous Materials Regulations.

Document 2026-21307 covers modification requests

The second notice lists applications to modify existing special permits. A request to modify a permit can concern the holder, packaging, material, mode, operational condition or another permit term. Publication of the request is not approval; regulated parties must wait for and follow the agency's actual action.

Document 2026-21306 covers new applications

The third notice lists applications for new special permits. These are requests for relief or an alternative safety approach under PHMSA's special-permit process. A new application number or Federal Register listing does not authorize a shipment before PHMSA grants the permit and its conditions are in force.

A special permit is not a blanket hazmat exemption

PHMSA special permits authorize a specific person to perform a regulated function that is not otherwise permitted, subject to conditions designed to achieve at least an equivalent level of safety or a safety level consistent with the public interest when an equivalent standard does not exist. Other companies cannot copy the relief simply because the notice is public.

Applicants and permit holders are the controlling identities

Before relying on a special permit, verify the permit number, holder name and whether the party using it is an authorized holder, party to the permit or otherwise covered by its terms. Similar corporate names, contractors and customers do not automatically share authorization.

Read the regulation and special-permit conditions together

A permit may provide relief only from identified sections of the HMR and only for listed materials, packages, quantities, modes or operations. All unaffected requirements continue to apply. The safe compliance question is not whether a permit exists, but whether this shipment and this party meet every applicable condition.

Applications do not change today's shipping rules

The modification and new-application notices are procedural publications. Until PHMSA issues an action, the applicant remains bound by the current regulations and any existing permit terms. Dispatch, packaging and shipping-paper systems should not be changed on the strength of an application notice.

Granted action still requires the issued permit text

A grant listed in an action notice should be followed by review of the issued special permit itself. Confirm its effective status, expiration or renewal terms, authorized modes, special provisions, marking and documentation instructions, training implications and emergency-response requirements before tendering or transporting a load.

Denied requests provide no operating authority

If PHMSA denies an application, the requested alternative may not be used on the basis of the filing. A company should continue under the HMR or another valid authorization and should route questions through its hazmat compliance and legal process rather than asking a driver to interpret a docket entry.

Motor carriers should verify offeror compliance

A carrier accepting hazmat under a special permit should obtain enough information to verify the permit, shipment description, packaging, markings, shipping papers and emergency information. Contract language does not shift away the carrier's own HMR duties. Stop and escalate when the permit number, holder or condition does not match.

Drivers need shipment-specific instructions

The driver should receive the shipping papers, emergency-response information, placards and any permit document or instruction required for the movement. Training should explain what the special permit changes and what it does not. A permit number alone is not a usable roadside procedure.

Fleet systems should track status and expiration

Create a controlled record for every special permit used: permit number, holder, materials, affected regulations, equipment, modes, start and expiration dates, responsible manager and source link. Add renewal alerts and a dispatch stop when the permit expires, is suspended, is modified or no longer fits the shipment.

The notices do not rewrite CDL or general hazmat rules

These publications do not create a new CDL endorsement, waive general driver qualification rules or broadly relax packaging, communication, security or incident-reporting requirements. They concern specific special-permit applications and actions. Any wider regulatory change would require a separate rulemaking or other legally effective action.

Primary-source note

This report is based on Federal Register documents 2026-21308, 2026-21307 and 2026-21306, all published October 19, 2026. CDL Truck Pro has described the three procedural categories exactly as the notices do and has not treated a pending application as an approval or an applicant-specific action as industry-wide relief.
