FMCSA Seeks Comment on Voluntary Operating-Authority Revocation Form OCE-46

October 24, 2026 13 min read

FMCSA is accepting comments through November 23 on renewing Form OCE-46, used by carriers, brokers and freight forwarders to request voluntary revocation of operating authority.

FMCSA published the notice on October 23

The Federal Motor Carrier Safety Administration published Federal Register document 2026-21647 on October 23, 2026. The notice concerns the information collection titled Request for Revocation of Authority Granted, OMB Control Number 2126-0018, and asks for public comment before FMCSA seeks renewed approval from the Office of Management and Budget.

Comments are due November 23

Comments on the information collection must be received on or before November 23, 2026. The notice directs commenters to Reginfo.gov and its list of information collections under 30-day review. This is the final 30-day Paperwork Reduction Act review stage described in the notice, not a new operating-authority compliance deadline for every carrier.

Form OCE-46 supports voluntary revocation

For-hire motor carriers, surface freight forwarders and property brokers can use Form OCE-46 to ask FMCSA to revoke all or part of operating authority registration. The request may reflect a suspended operation, business restructuring or another registrant decision. It is not the same as merely ceasing dispatches while leaving the federal record unchanged.

The notice renews paperwork approval, not a new revocation rule

FMCSA is seeking renewal of an existing information collection under the Paperwork Reduction Act. The October 23 publication does not automatically revoke any MC, MX or FF authority, require all registrants to file OCE-46 or establish a new filing fee. A registrant acts only if it chooses to request voluntary revocation or another requirement separately applies.

A registrant may revoke only part of its authority

The notice explains that a business may request revocation of some, but not all, operating authority for legitimate business reasons. The form and FMCSA record should identify the exact docket and authority affected. Do not assume that revoking one authority category closes every related registration or operating privilege.

Voluntary and involuntary revocation have the same authority effect

FMCSA states that failure to maintain evidence of required insurance can cause involuntary revocation, while OCE-46 is used for a voluntary request. Although the immediate effect on the authority is the same, the cause, filing history and corrective path are different. A voluntary filing should not be described as an insurance cancellation action.

Operating authority and the USDOT record are separate

An MC, MX or FF operating-authority registration is not identical to a USDOT number or the safety-registration record. Current FMCSA instructions should be followed for any related MCS-150 status change. A carrier should verify both records after processing rather than assuming one revocation automatically completes every closure step.

The agency estimates 5,711 annual filings

FMCSA now estimates 5,711 respondents per year, down from 8,699 in the prior estimate. That is a projected Paperwork Reduction Act workload, not the number of authorities revoked in October or a forecast that 5,711 carriers will leave the market in 2026.

Each response is estimated at 15 minutes

The agency uses an estimated 15 minutes per response and calculates 1,428 total annual burden hours. This standardized estimate supports OMB review. It does not include every business, insurance, contractual, tax or state-level task a registrant might need to complete when suspending operations.

FMCSA estimates $51,422 in annual industry labor cost

The notice estimates annual labor cost of $51,422 for submitting the form, a decrease of $15,765 from the prior estimate. The change reflects fewer expected filings. These are aggregate information-collection estimates and should not be treated as a quoted service price or the cost of closing an individual business.

About 27 percent are expected to file by mail

Although online submission is available, FMCSA estimates that approximately 1,517 respondents, about 27 percent of the total, will continue filing by mail and incur notarization and postage costs. The current OCE-46 instructions require complete identifying information, an authorized signature and notarization.

A request should be followed through the official record

Submitting a form is not the final verification step. Preserve the filed form and confirmation, monitor FMCSA's Licensing and Insurance record, coordinate insurance and process-agent changes when applicable and stop regulated operations only under a documented compliance plan. Do not rely solely on a vendor email or an unchecked copy of the form.

The earlier comment period drew no comments

FMCSA first published a 60-day notice on May 14, 2026. That comment period closed July 13 and the agency reported receiving no comments. The October notice now invites comments on necessity, burden estimates, information quality and ways to reduce burden without reducing the usefulness of the collection.

Primary-source note

This report is based on Federal Register document 2026-21647, published October 23, 2026, FMCSA's official Form OCE-46 page and current registration guidance. CDL Truck Pro has not treated the notice as a mass revocation, a new filing requirement, a USDOT-number deactivation or evidence that the estimated annual respondents have already stopped operating.
